Shipping policy
ARTICLE 6 | SHIPPING AND DELIVERY OF PRODUCTS
- Shipping of standard products within The Netherlands, Belgium, Germany and Austria are free of charge unless otherwise specifically mentioned on the product page when ordering on the website.
- Shipping of custom-made products is possible. Please contact KuvaLight (info@kuvalight.com) to request an offer for the requested custom-made product including shipping.
- Worldwide shipping to countries outside of The Netherlands, Belgium, Germany, and Austria is possible. Please contact KuvaLight (info@kuvalight.com) to request an offer for the requested product including shipping.
-
Delivery of products takes place by shipping them to the delivery address provided by the customer, unless expressly agreed otherwise. If no delivery address has been provided by the customer, the invoice address or any other address known to KuvaLight will be used as the delivery address.
-
The risk of loss and damage to the products transfers to the customer at the moment the products are received by or on behalf of the customer.
-
KuvaLight reserves the right to deliver orders in installments unless this cannot reasonably be expected from the customer. If an order is delivered in multiple shipments, the consumer’s cancellation period, as referred to in Article 19 and beyond, will only begin once the final part of the order has been received by or on behalf of the consumer.
-
If the delivery period indicated by KuvaLight is exceeded, the customer is never entitled to refuse receipt of the products or to withhold payment of the amounts due under the agreement. If KuvaLight incurs additional costs due to circumstances attributable to the customer that would not have existed had the products been received at the intended time of delivery, these additional costs shall be borne by the customer. These costs may include, but are not limited to, additional charges for multiple delivery attempts and reasonable storage costs determined by KuvaLight.
ARTICLE 7 | DELIVERY TIMES
-
For products that are not available from stock, a standard delivery time of approximately four to six weeks applies from the conclusion of the agreement. KuvaLight will make every effort to meet this timeframe, as well as any expressly agreed delivery times; however, these are indicative estimates and not binding deadlines. KuvaLight shall not be considered in default until the customer has issued a written notice of default, specifying a reasonable period for fulfillment, and KuvaLight has failed to comply within that period.
-
If KuvaLight depends on information to be provided by the customer to fulfill the agreement, the delivery time, as referred to in the previous paragraph, will not commence until KuvaLight has received the necessary information.
ARTICLE 8 | INSPECTION AND COMPLAINTS
-
1) At the time of delivery, or immediately thereafter, the counterparty must examine whether the condition and quantity of the products correspond to the agreement. If, in the opinion of the counterparty, the condition and/or quantity of the products do not conform to the agreement, the counterparty must notify KuvaLight of this at the time of delivery, or immediately thereafter.
-
In the case of defects that were not reasonably visible or otherwise recognizable at the time of delivery, the customer must notify KuvaLight in writing within seven days after discovering the defect or within a period in which they reasonably could have discovered it.
-
If the customer fails to submit a complaint in time, KuvaLight is not obligated to take any action regarding the complaint.
-
Even if the customer submits a timely complaint, their obligation to make timely payments to KuvaLight remains unaffected.
-
The above provisions do not affect consumers’ statutory rights. This includes, among other things, the right to file a legal claim or defense regarding a defect in a consumer purchase, which expires if the consumer does not notify KuvaLight of the defect within two months after its discovery.
